Terms of Use

Effective September 22, 2026

These Terms of Use (these "Terms") are an agreement between you and LegalCare, P.C. and Legal Labs, Inc. (collectively, "LegalCare," "we," "us," or "our"). They govern your use of our website and your other interactions with us about our services, including when you speak with us by phone, message us, schedule or participate in an advice session, or otherwise communicate with us (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY. SECTION 13 CONTAINS AN ARBITRATION AGREEMENT. UNLESS YOU OPT OUT AS DESCRIBED IN SECTION 13.11, IT REQUIRES YOU AND LEGALCARE TO RESOLVE MOST DISPUTES BETWEEN US, INCLUDING CLAIMS FOR LEGAL MALPRACTICE, THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

1. Accepting These Terms

1.1 Agreement. You accept these Terms by using our website or by accepting our Advice Session Terms, which refer to these Terms. If you do not agree to these Terms, do not use or access the Services.

1.2 Other Terms That Apply to You. Our Privacy Policy describes how we collect, use, disclose, retain, and protect your information. If you schedule an advice session, our Advice Session Terms describe the scope of our relationship with you, including when you become a prospective client and a client of LegalCare, P.C. If a conflict exists between these Terms and the Advice Session Terms concerning your advice session or our legal representation of you, the Advice Session Terms control, except that Section 13 (Arbitration Agreement) governs how disputes between you and LegalCare are resolved.

1.3 Eligibility. You must be at least 18 years old to use the Services or participate in an advice session. You may use the Services to seek help with your own legal matter, or with the legal matter of another person (such as your minor child) only if you are legally entitled to act on that person's behalf.

1.4 Lawyers in Our Network. If you are a lawyer or law firm that participates in our network, your written agreement with LegalCare governs your participation in the network and controls over these Terms if the two conflict. These Terms otherwise apply to your use of the Services.

2. About LegalCare and Our Services

2.1 Who We Are. LegalCare, P.C. is a California law firm. It provides limited-scope legal advice sessions and, when appropriate, helps clients find other lawyers for ongoing representation. The Advice Session Terms explain the services it may provide. Legal Labs, Inc. is a technology company that provides technology used to deliver the Services. Legal Labs, Inc. is not a law firm, does not provide legal advice or legal services, and does not act as your lawyer.

2.2 No Attorney-Client Relationship Through Use of the Services Alone. Visiting our website, calling, texting, or emailing us, answering our intake questions, or scheduling an advice session does not by itself make LegalCare, P.C. your lawyer. The Advice Session Terms explain when you become its prospective client and when you become its client. LegalCare has no obligation to accept your matter or to provide you an advice session.

2.3 Scope of Our Services. Any legal services LegalCare, P.C. provides to you are limited in scope, as described in the Advice Session Terms or any other written agreement between you and LegalCare. We cannot guarantee any particular result.

2.4 Deadlines and Emergencies. Legal claims and defenses are subject to strict deadlines, and some cannot be extended. Do not wait for a response from us, for your advice session, or for a referral before taking any step needed to protect your rights. The Services are not an emergency service. If you are in danger, call 911.

2.5 Referrals from Third Parties. If a third party, such as another business or law firm, refers or directs you to LegalCare, that third party is independent of LegalCare. It is not our agent, and we are not responsible for its services, its communications with you, or its handling of your information.

3. Network Lawyers

3.1 Independent Lawyers. LegalCare works with a network of independent lawyers and law firms ("Network Lawyers"). Network Lawyers are not employees, partners, shareholders, or agents of LegalCare. Each Network Lawyer is responsible for the legal services it provides and for complying with its own professional obligations.

3.2 Our Recommendations. When we recommend a Network Lawyer, we try to identify a lawyer suited to your needs and budget based on the information available to us. A recommendation is not a guarantee that the lawyer will be available, will accept your matter, or will achieve any particular result. A Network Lawyer may decline to represent you. Whether to hire a lawyer we recommend is your decision, and you are free to hire any lawyer you choose, including one outside our network.

3.3 Your Agreement with a Network Lawyer. If you hire a Network Lawyer, your relationship with that lawyer is governed by your agreement with that lawyer. Unless LegalCare has agreed in writing to share responsibility for your matter, LegalCare is not responsible for the advice, services, acts, or omissions of any Network Lawyer.

3.4 Payments. Payments you make through the Services may be processed by third-party payment processors and are subject to the terms presented to you when you make them.

4. Information You Provide

4.1 Accuracy. You agree to provide accurate and complete information. Our ability to evaluate your matter and advise you depends on the accuracy and completeness of the information you give us.

4.2 Confidentiality. We treat information you give us about your legal matter as confidential in accordance with the rules of professional conduct that govern lawyers, including the duties lawyers owe to prospective clients, and as described in the Advice Session Terms and our Privacy Policy. However, providing information to us does not by itself make you a client of LegalCare, P.C., and whether a particular communication is protected by the attorney-client privilege depends on the circumstances and applicable law.

4.3 Information About Other People. To evaluate your matter and check for conflicts of interest, we may ask about other people or entities involved in your matter. Please share only information that is relevant to your matter and that you are legally permitted to share.

4.4 Information Not to Send. Unless we ask for it through a method we designate, do not send us Social Security numbers, full payment card or bank account numbers, passwords, or similar credentials.

4.5 Our Use of Your Information. You keep any rights you have in the information and documents you provide to us. You permit LegalCare and its service providers to use them to provide the Services and as described in the Advice Session Terms and our Privacy Policy.

4.6 Feedback. If you send us suggestions or other feedback about the Services, we may use that feedback without restriction or compensation to you. This Section 4.6 does not apply to information about your legal matter.

5. Recording, Transcription, and Technology

5.1 Recording and Transcription. Calls with LegalCare may be recorded, transcribed, or both. We will tell you if a call is being recorded. By continuing a call after we tell you it is being recorded or transcribed, you consent to the recording or transcription. You may not record a call with LegalCare without our consent.

5.2 Technology and Artificial Intelligence. We use technology, including artificial intelligence tools, to operate the Services and support our legal work. Automated tools we use to communicate with you are not lawyers and do not give legal advice. Any legal advice you receive from LegalCare, P.C. comes from a licensed attorney, who is responsible for that advice regardless of the tools used. Our Privacy Policy describes how information is handled when we use these tools.

6. Communications

6.1 Electronic Communications. You agree that we may provide agreements, notices, disclosures, and other communications to you electronically, including by email, text message, or posting on our website, to the extent permitted by law. Electronic communications satisfy any legal requirement that a communication be in writing. Please keep your contact information current with us.

6.2 Electronic Signatures. You may accept agreements, give consents, and sign documents in connection with the Services electronically, such as by clicking a button, typing your name, or replying to a text message. Your electronic acceptance or signature has the same legal effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act and the California Uniform Electronic Transactions Act. You may request a paper copy of any agreement you accepted electronically, or withdraw your consent to sign electronically, by contacting us as provided in Section 18. Withdrawing your consent does not affect the validity of anything you signed before the withdrawal.

6.3 Calls and Text Messages. By providing us your phone number, you agree that LegalCare and those acting on our behalf may call and text you at that number about the Services and your matter. These calls and texts may be made using automated technology and may include prerecorded or artificial voice messages. Message frequency varies. Message and data rates may apply. Reply STOP to stop receiving text messages, or reply HELP for help. After you reply STOP, we may send one message confirming your request, and we may still contact you by other means about your matter. Wireless carriers are not liable for delayed or undelivered messages. Provide only phone numbers that you are authorized to use, and tell us promptly if your number changes. Our Privacy Policy describes how we handle text-messaging information.

7. Website Content

7.1 General Information Only. Content on our website is general information only. It is not legal advice, may not reflect the most current law, and may not apply to your situation. Do not act or refrain from acting based on our website content without advice from a lawyer about your specific situation.

7.2 Attorney Advertising. Our website may be considered attorney advertising. Any description of prior results, testimonial, or endorsement does not guarantee, warrant, or predict the outcome of your legal matter, and every matter must be evaluated on its own facts. LegalCare, P.C. is a California law firm located at P.O. Box 14655, Van Nuys, CA 91409. The attorney responsible for the content of this website is Kevin Navi (California State Bar No. 364091).

7.3 Third-Party Websites and Services. The Services may link to or rely on websites, applications, or services that LegalCare does not own or control. We are not responsible for their content, terms, or privacy practices, and your use of them is governed by their own terms.

8. Accounts and Secure Links

If we give you an account, a secure link, or an access code, keep it confidential and do not share it with anyone. You are responsible for activity that occurs through your account, link, or code. Tell us promptly if you believe it has been used without your permission.

9. Acceptable Use

You agree not to:

  • use the Services in violation of any law or to pursue any unlawful purpose;
  • impersonate any person, misrepresent your identity or your authority to act for another person, or provide information you know to be false;
  • harass, threaten, or abuse LegalCare personnel, attorneys, or Network Lawyers;
  • use the Services to obtain information about another person's matter or to gain an unfair advantage against a person whom LegalCare, P.C. represents or has represented;
  • interfere with, disrupt, or attempt to gain unauthorized access to the Services or the systems used to provide them;
  • introduce viruses or other malicious code;
  • use any robot, scraper, or other automated means to access, copy, or collect content or data from the Services; or
  • copy, modify, distribute, sell, or create derivative works from the Services, except as these Terms permit.

Nothing in these Terms restricts you from making truthful statements about LegalCare, including posting an honest review of our Services.

10. Intellectual Property

10.1 Ownership. LegalCare and its licensors own the Services, including the website and its content, design, software, and trademarks. Except for the limited rights granted in Section 10.2, these Terms do not give you any right, title, or interest in the Services.

10.2 Limited License. Subject to these Terms, you may access and view our website content for your personal, non-commercial use. You may not use our names, logos, or trademarks without our prior written consent.

10.3 Copyright Complaints. If you believe content on our website infringes your copyright, send a notice to the contact information in Section 18 that complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(3).

11. Disclaimers

EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR THE ADVICE SESSION TERMS, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND THE TECHNOLOGY WE USE TO PROVIDE THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NONE OF THE LEGALCARE PARTIES (AS DEFINED IN SECTION 12.1) WARRANTS THAT THE WEBSITE OR THAT TECHNOLOGY WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

This Section 11 does not limit any duty LegalCare, P.C. owes you as a client or prospective client under applicable law or the rules of professional conduct that govern lawyers.

12. Limitation of Liability; Indemnification

12.1 Limitation of Liability. SUBJECT TO SECTION 12.3, AND TO THE FULLEST EXTENT PERMITTED BY LAW: (A) LEGALCARE, ITS AFFILIATES AND SERVICE PROVIDERS, AND THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND INDEPENDENT CONTRACTORS, INCLUDING ATTORNEYS LEGALCARE ENGAGES TO PROVIDE LEGAL SERVICES, BUT EXCLUDING NETWORK LAWYERS (COLLECTIVELY, THE "LEGALCARE PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES; AND (B) THE LEGALCARE PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

12.2 Network Lawyers and Other Third Parties. Unless LegalCare has agreed in writing to share responsibility for your matter, the LegalCare Parties are not liable for the advice, services, acts, or omissions of any Network Lawyer. The LegalCare Parties are also not liable for the acts or omissions of any third party that referred or directed you to LegalCare, or of any third-party website or service described in Section 7.3.

12.3 Exceptions. Nothing in these Terms limits or excludes (a) LegalCare, P.C.'s liability to a client or prospective client for professional malpractice or breach of a lawyer's professional duties, or any other liability that a lawyer may not limit under the California Rules of Professional Conduct; (b) liability for fraud, willful injury, gross negligence, or violation of law, to the extent California Civil Code Section 1668 or other applicable law does not permit that liability to be limited; or (c) any other liability that cannot be limited or excluded under applicable law.

12.4 Indemnification. To the fullest extent permitted by law, you agree to indemnify and hold harmless the LegalCare Parties from any third-party claims, losses, and expenses (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) your violation of any law or the rights of any third party, or (c) information you provided to us that you did not have the right to provide. This Section 12.4 does not apply to any claim to the extent it arises from the legal services LegalCare, P.C. provided to you or from a LegalCare Party's own negligence or misconduct.

13. Arbitration Agreement

13.1 What Arbitration Means. In arbitration, a neutral arbitrator, rather than a judge or jury, decides the dispute. Arbitration follows fewer formal procedures than court, allows more limited discovery, eliminates some rights and protections for both parties, and rarely allows for appeal or court review. An arbitrator can award the same individual damages and relief that a court could. Because LegalCare, P.C. is a law firm and this Arbitration Agreement applies to claims you may have against us, you may wish to consult an independent lawyer before agreeing to it. You may opt out of this Arbitration Agreement as described in Section 13.11.

13.2 Disputes Covered. Except as provided in Section 13.3, you and LegalCare agree to resolve any dispute, claim, or controversy between you and any LegalCare Party that arises out of or relates to these Terms, the Advice Session Terms, the Services, any advice session, any legal services provided by LegalCare, P.C. or by attorneys it engages, or any communications between you and LegalCare (each, a "Dispute") exclusively through final and binding individual arbitration. This includes Disputes based on contract, tort, statute, or any other legal theory, including claims for professional negligence, legal malpractice, and breach of fiduciary duty, and Disputes that arose before you accepted these Terms. The LegalCare Parties are intended third-party beneficiaries of this Arbitration Agreement.

13.3 Exceptions. This Arbitration Agreement does not require arbitration of the following:

  • Small claims. Either party may bring an individual claim in small claims court if the claim qualifies and remains in that court.
  • Fee arbitration. In any dispute concerning fees and costs, you have the right to elect non-binding arbitration under California's Mandatory Fee Arbitration Act (California Business and Professions Code Sections 6200-6206) before the dispute becomes subject to binding arbitration under this Arbitration Agreement. If the resulting award is not binding and a party timely seeks further proceedings, the dispute will then be resolved by binding arbitration under this Arbitration Agreement rather than in court.
  • Intellectual property. Either party may bring an action in court to enjoin infringement or other misuse of intellectual property rights.
  • Public injunctive relief. Requests for public injunctive relief are governed by Section 13.9.
  • Disputes with Network Lawyers. This Arbitration Agreement does not govern Disputes between you and a Network Lawyer, which are governed by your agreement with that lawyer, and Network Lawyers are not third-party beneficiaries of it. Any claim you bring against LegalCare remains subject to this Arbitration Agreement even if you also bring claims against a Network Lawyer.

13.4 Informal Resolution First. Before starting an arbitration, the party with the Dispute must send the other a written notice ("Notice of Dispute") that includes the claimant's name and contact information, a description of the Dispute, and the relief sought. Notices to LegalCare must be sent to the contact information in Section 18. Notices to you will be sent to the most recent email address or mailing address we have for you. For 60 days after the Notice of Dispute is received, you and LegalCare will try in good faith to resolve the Dispute informally, and either party may request a call for that purpose. All applicable statutes of limitation and filing deadlines are tolled from the date the Notice of Dispute is received until the end of this 60-day period. If the Dispute is not resolved within 60 days, either party may start arbitration.

13.5 Rules and Administrator. The Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this Arbitration Agreement. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules & Procedures if no claim or counterclaim exceeds $250,000 (excluding attorneys' fees and costs), and otherwise under its Comprehensive Arbitration Rules & Procedures, in each case together with the JAMS Policy on Consumer Arbitrations Pursuant to Pre-Dispute Clauses Minimum Standards of Procedural Fairness (the "Consumer Minimum Standards") and, where applicable, the JAMS Mass Arbitration Procedures and Guidelines (collectively, the "JAMS Rules"), as modified by this Arbitration Agreement. The JAMS Rules are available at www.jamsadr.com. If JAMS is unable or unwilling to administer the arbitration, the parties will agree on another administrator, or a court will appoint one. The arbitration will be conducted by a single arbitrator who is a retired judge or a lawyer licensed to practice law in California.

13.6 Location and Hearing. Any in-person hearing will take place in the county where you reside or in San Francisco County, California, at your election. Either party may request that a hearing be conducted by video or telephone. If your claim is for $25,000 or less, you may choose to have the arbitration conducted solely on the basis of written submissions.

13.7 Fees and Costs. Payment of filing, administrative, and arbitrator fees will be governed by the JAMS Rules. Under the Consumer Minimum Standards, the only fee you may be required to pay is JAMS's consumer filing fee, and LegalCare will pay all other fees and costs that the JAMS Rules or applicable law require a business to pay, within the time applicable law requires. If your claim is for $10,000 or less, LegalCare will reimburse your filing fee unless the arbitrator finds your claim frivolous or brought for an improper purpose. Each party will bear its own attorneys' fees and costs, except that the arbitrator may award attorneys' fees and costs to the extent a court could under applicable law.

13.8 Individual Arbitration Only; Waiver of Class Actions and Jury Trial. YOU AND LEGALCARE AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one person, and may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. YOU AND LEGALCARE EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE COVERED BY THIS ARBITRATION AGREEMENT.

13.9 Public Injunctive Relief. If a claim seeks public injunctive relief (that is, injunctive relief whose primary purpose and effect is to prohibit unlawful acts that threaten future injury to the general public), and a court determines that the right to seek that relief cannot be waived under applicable law, then that request for relief will be severed and decided by a court, after the arbitrator has resolved all other claims and requests for relief, and litigation of that request will be stayed until then.

13.10 Mass Arbitration. If 25 or more demands for arbitration raising similar claims are filed against LegalCare by the same or coordinated counsel, the parties agree that the JAMS Mass Arbitration Procedures and Guidelines will apply to those demands, using a threshold of 25 demands in place of the threshold stated in those procedures, and the parties will cooperate in good faith with JAMS to resolve the demands efficiently and fairly. All applicable statutes of limitation and filing deadlines are tolled for each claimant while that claimant's demand is pending under this Section 13.10.

13.11 Right to Opt Out. You may opt out of this Arbitration Agreement by sending an email to the address in Section 18, with the subject line "Arbitration Opt-Out," within 30 days after the date you first accept these Terms or the Advice Session Terms, whichever is earlier. Your email must include your name, your phone number, and a clear statement that you are opting out of the LegalCare Arbitration Agreement. If you opt out, neither you nor LegalCare will be bound by this Arbitration Agreement, and Disputes will be resolved in court under Section 14. Opting out does not affect any other part of these Terms or the Advice Session Terms, or your rights under the Mandatory Fee Arbitration Act.

13.12 Who Decides. The arbitrator will decide all issues relating to the scope, interpretation, applicability, and enforceability of this Arbitration Agreement, except that a court will decide (a) whether you validly opted out under Section 13.11, and (b) any issue relating to the enforceability or application of Sections 13.8, 13.9, or 13.10.

13.13 Severability. If any part of Section 13.8 is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and decided by a court, not in arbitration, and will be stayed until the arbitration of the remaining claims is complete. In no event will a Dispute proceed as a class or collective arbitration. If any other part of this Arbitration Agreement is found unenforceable, that part will be severed and the rest will remain in effect.

13.14 Changes to This Arbitration Agreement. If LegalCare makes a material change to this Arbitration Agreement, you may reject the change by sending us an email to the address in Section 18 within 30 days after the change takes effect. If you reject the change, the version of this Arbitration Agreement in effect before the change will continue to apply to Disputes between us. No change will apply to a Dispute for which a Notice of Dispute was sent before the change took effect.

13.15 Survival. This Arbitration Agreement survives the end of your use of the Services and the end of any attorney-client relationship between you and LegalCare, P.C.

14. Governing Law and Venue

The Federal Arbitration Act governs Section 13. Otherwise, these Terms and any Dispute are governed by California law, without regard to its conflict-of-law rules. Any Dispute that is not subject to arbitration will be brought exclusively in the state courts of California or the federal courts located in California, except that either party may bring a qualifying claim in small claims court in the county where you reside. You and LegalCare consent to the personal jurisdiction of those courts.

15. Changes to the Services; Suspension and Termination

We may change, suspend, or discontinue any part of the Services at any time, consistent with our professional obligations, including the obligations of LegalCare, P.C. to any client it is then representing. You may stop using the Services at any time. LegalCare may suspend or end your access to the Services at any time, consistent with our professional obligations, including if you violate these Terms. The Advice Session Terms govern when our representation of you ends. Sections 3.3, 4.5, 4.6, 10, 11, 12, 13, 14, 15, 17, and 18 survive any suspension or termination.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on our website and update the Effective Date above. If we make a material change, we will provide reasonable advance notice, which may include notice by email or text message. Changes apply only going forward, and your continued use of the Services after the updated Terms take effect means you accept them. Changes to these Terms do not change the scope of any representation or the terms of any Advice Session Terms you have already accepted. Section 13.14 governs changes to the Arbitration Agreement.

17. General Terms

17.1 Entire Agreement. These Terms are the entire agreement between you and LegalCare concerning their subject matter. If you have accepted the Advice Session Terms, Section 1.2 governs how these Terms and the Advice Session Terms apply together. If you and LegalCare have entered into any other written agreement, that agreement controls over these Terms with respect to its subject matter. Our Privacy Policy describes our privacy practices and is not part of these Terms.

17.2 Assignment. You may not assign or transfer these Terms without our prior written consent. LegalCare may assign these Terms, subject to applicable law and our professional obligations, including in connection with a merger, acquisition, reorganization, or sale of assets.

17.3 Severability; No Waiver. Except as provided in Section 13.13, if any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later.

17.4 No Other Third-Party Beneficiaries. Except for the LegalCare Parties as provided in Sections 11, 12, and 13, these Terms do not create any third-party beneficiary rights.

17.5 Events Beyond Our Control. LegalCare is not responsible for any delay or failure to perform caused by events beyond our reasonable control, including outages of telephone, internet, or third-party services.

17.6 Interpretation. Headings are for convenience only. The word "including" means "including without limitation."

17.7 Notice to California Residents. Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
